Thank you for your interest in employment with Panda Restaurant Group, Inc. This Job Applicant Privacy Notice discloses the privacy practices of Panda Restaurant Group, Inc., and its affiliates, subsidiaries and related entities including, but not limited to Panda Express, Panda Inn, Raising Cane’s, Yakiya, and Hibachi San locations owned and operated by us (collectively, “Panda” or “we” or “us”) with respect to any and all personal information collected in connection with your application for employment and hiring with Panda, including but not limited to the information collected during, related to, and/or submitted via the online employment application process; your resume or curriculum vitae, cover letter or message, letters of recommendation, or any other information you may submit; background checks; interviews; and pre-employment screening. Personal Information ("Recruitment Information") means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA") (collectively, "California Privacy Law"), Panda is required to provide a privacy notice in a specified format. California Notice at Collection
The Company collects the Recruitment Information identified in the section of this Policy entitled “Collection of Information”, for the purposes described in the section entitled “Purposes of Use.” The Company retains this information for the period described in the section of this Policy entitled “Retention of Personal Information.” We do not sell your personal information or disclose it for cross-context behavioral advertising (“sharing”). We also do not collect or process sensitive personal information for the purpose of inferring characteristics about you.

Collection of Information
We may collect the following categories of Recruitment Information and other information that may relate to you when you apply for employment with us:
- Identifiers, including but not limited to your name, email address, mailing address, phone number, alias, account name, device identifier, Internet Protocol address, cookies, beacons, or similar technology.
- Personal information described in California Civil Code Section 1798.80(e), including but not limited to your physical characteristics, medical information, social security number, and driver’s license or state identification card number.
- Characteristics of legally protected classifications, including but not limited to race, ethnicity, gender, military or veteran status, age, immigration status, medical condition, and medical or physical disability (if provided voluntarily).
- Internet or other electronic network activity information, including but not limited to browsing history, search history, browser type, and other information regarding your access or interaction with our websites.
- Geolocation data, our website may ask permission to use your location to help you search for a job near you. Our website may collect your location, only if you provide permission.
- Professional or employment-related information, including but not limited to your employment history, employer, job title, professional certifications, language capabilities, and compensation.
- Education information, including but not limited to your highest level of education completed, school attended, major of study, graduation year, and degree.
- Inferences, drawn from the above types of personal information, including but not limited to application-related assessments, your area/department/role of interest within Panda, and other inferences reflecting your preferences, characteristics, attitudes, intelligence, abilities, or aptitudes. We do not collect sensitive personal information or characteristics of protected classifications for the purpose of inferring characteristics.
Certain California Recruitment Information that Panda collects about you may be considered sensitive personal information within the meaning of the California Privacy Law, including: social security number (for background check purposes); driver's license number and passport number (for background checks in connection with employment and/or onboarding purposes); and racial or ethnic origin, religious or philosophical beliefs, and information about sex life or sexual orientation (for inclusion, diversity, and related purposes).
Panda only uses and discloses sensitive personal information as necessary to perform functions related to your application and hiring and to comply with federal, state, or local laws, and otherwise as permitted California Privacy Law.
Sources of Information
Panda generally sources Recruitment Information either (a) directly from you (for instance when you provide information as part of your application or during the recruitment process) or (b) from third parties (such as recruitment agencies and former employers). If required by law, Panda will indicate whether the information requested is mandatory or optional. If you fail to provide mandatory information, in some circumstances this may mean Panda is unable to process your application.
Purposes of Use
Panda will use the Recruitment Information collected when you apply for employment with Panda for one or more of the following businesses purposes:
- To evaluate you for the specific position you have applied for.
- To evaluate your application for other open or similar positions within Panda.
- To process your application.
- To communicate with you about your application and related items, issues, or events.
- To contact your references.
- To conduct background checks.
- To hire you.
- To comply with applicable legal, regulatory, record-keeping, and/or reporting requirements or obligations.
- To assess or improve our application process and related websites, digital interfaces, and technology.
- To establish, exercise, or defend against legal claims.
Disclosures of Recruitment Information
We may disclose Recruitment Information to third parties for the business purposes described above, including that we disclose:
- Identifiers and other Recruitment Information to service providers to conduct and manage the recruitment process and to perform data processing activities on our behalf, and subject to appropriate privacy and security obligations.
- Recruitment Information to government and other authorities as required by law.
- Recruitment Information to other members of the Panda family of companies to: (a) help ensure security and integrity, (b) perform debugging, (c) conduct internal research, and (d) carry out activities to maintain or improve the quality or safety of a service or device.
- Recruitment information to others to the extent necessary to comply with applicable law and/or as otherwise permitted under California Privacy Law.
We do not disclose Recruitment Information of applicants in California for commercial purposes, such as marketing. We do not engage in the sale or sharing of Recruitment Information as those terms are defined under California Privacy Law. We do not use or disclose Recruitment Information that is sensitive personal information except as necessary to support and process your application, to comply with law and regulation, and otherwise as permitted by California Privacy Law.
Security
The security and confidentiality of your Recruitment Information matters to us. That’s why we have technical, administrative, and physical controls in place to protect your Recruitment Information from unauthorized access, use, and disclosure. Our outside service providers must also protect your Recruitment Information and use it only to meet our business needs. We also take steps to protect our systems from unauthorized access. And we comply with all laws that apply to us, including California Privacy Law. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially reasonable means to protect the Recruitment Information we receive, we cannot guarantee its absolute security. Moreover, we are not responsible for the security of information you transmit to the Website over networks that we do not control, including the Internet and wireless networks.
Retention of Personal Information
We retain your Recruitment Information for as long as needed or permitted in light of the purpose(s) for which it was obtained. As well as for any additional period as required by applicable law or regulation, contract requirements, in support of legal proceedings, or audit requirements, in accordance with the records management policy.
If Panda hires you, the Recruitment Information may become part of your personnel file and may be used to administer the employment relationship and for related reporting and recordkeeping purposes. Panda will retain application information for the entire duration of your employment relationship with Panda and for as long thereafter as permitted or required by applicable law. Panda makes its document retention schedule available to employees for review.
Panda will retain Recruitment Information of applicants who are not hired for at least one year and longer if required by applicable law, such as for four years for California residents. These records will be retained for our internal recordkeeping and reporting purposes. During this retention period, we may use your Recruitment Information to consider you for positions in addition to the position(s) for which you initially applied.
California Applicant Rights
Your Rights. Subject to exceptions detailed in the California Privacy Law, as a California resident, you have the right to request: (i) deletion of California Recruitment Information that we obtained from you; (ii) correction of inaccurate California Recruitment Information; (iii) the right to know the categories of California Recruitment Information that we collect about you, including the specific pieces of such information; and (iv) the right to know the categories of California Recruitment Information disclosed for business purposes.
Exercising Your Rights. If you are a California resident and wish to request the exercise of these rights as detailed above or have questions regarding recruitment information collected or shared with third parties, you may do so by:
- Clicking on the Do Not Sell or Share My Personal Information link located at pandarg.com or pandaexpress.com and submitting your request online by using our Privacy Rights Form. Please make sure that you identify yourself as a “Applicant” when submitting the request.
- Calling us at (800) 877-8988 (toll free).
Panda may apply any exceptions or other conditions available under law when responding to correction, deletion, or other requests. Panda will generally fulfill requests to know, correction, and deletion within 45 days of receiving a valid request. Panda may extend the respond time by another 45 days by notifying the individual of the time extension.
The Company will not unlawfully discriminate or retaliate against you for the exercise of the privacy rights conferred by the California Privacy Law. However, please note that if the exercise of the rights described above limits our ability to process your Recruitment Information (such as in the case of a deletion request), we may no longer be able to provide you our products or services or engage with you in the same manner.
We do not engage in providing financial incentives for the disclosure of Recruitment Information.
Authorized Agents. To the extent that you elect to designate an authorized agent to make a request on your behalf, they must provide appropriate documentation including written signed permission from you, proof of your identity, and verification of their identity; or a valid, designated power of attorney as defined under the California Probate Code.
Accuracy of Information
By consenting to the Policy, you hereby acknowledge and confirm that all information you provide to us is complete, accurate, and up to date. Other Disclosures
Our website does not respond to do-not-track signals, except in the context of Global Privacy Control.
